Welcome to Peekaboo Planet. These Terms & Conditions (“Terms”) govern your access to and use of the Peekaboo Planet website, mobile application, content, features, and related services (collectively, the “Services”).
The Services are operated by Peekaboo Planet LLC (“Peekaboo Planet,” “we,” “us,” or “our”).
By accessing or using our Services, you agree to these Terms. If you do not agree with these Terms, please do not use the Services.
1. About Peekaboo Planet
Peekaboo Planet provides interactive educational experiences designed to help children explore and learn through augmented reality (“AR”), audio, visual content, interactive activities, and other educational features.
Our goal is to make learning more engaging by allowing children to interact with educational content in their physical environment.
2. Parents and Guardians
Peekaboo Planet is designed for use by children under the supervision and guidance of a parent, legal guardian, teacher, or other responsible adult.
If you permit a child to use Peekaboo Planet, you are responsible for supervising the child's use of the Services and determining whether the content and experience are appropriate for that child.
Adults who create accounts, make purchases, provide permissions, or otherwise use the Services on behalf of a child represent that they have the authority to do so.
3. Children's Privacy
Protecting children's privacy is important to us.
Our collection, use, and handling of personal information is governed by our Privacy Policy. Where applicable, we intend to comply with laws governing children's privacy, including the Children's Online Privacy Protection Act (“COPPA”).
Parents and guardians should review our Privacy Policy before allowing a child to use the Services.
4. Augmented Reality Safety
Certain Peekaboo Planet features use augmented reality and may require users to move their device or interact with virtual objects appearing within their physical surroundings.
Children should use AR features under appropriate adult supervision.
Users should remain aware of their physical surroundings while using AR features and should not use the application while walking near traffic, stairs, bodies of water, hazardous objects, or other potentially unsafe environments.
Peekaboo Planet is not responsible for injuries, accidents, or property damage resulting from unsafe or inappropriate use of AR features, to the extent permitted by applicable law.
5. Educational Content
Peekaboo Planet provides content for general educational and entertainment purposes.
Although we strive to provide accurate, age-appropriate, and useful educational information, we do not guarantee that all information will always be complete, error-free, or suitable for every child's educational needs.
Peekaboo Planet is not a substitute for professional educational, medical, psychological, or other professional advice.
6. Acceptable Use
You agree not to misuse the Services. You may not:
Copy, reproduce, distribute, sell, or commercially exploit Peekaboo Planet content without authorization.
Reverse engineer, modify, decompile, or attempt to extract the source code of the application except where applicable law expressly permits it.
Attempt to interfere with the security or operation of the Services.
Use the Services for unlawful, fraudulent, or harmful purposes.
Access the Services through unauthorized automated methods.
Misrepresent your identity or your authority to act on behalf of another person.
We may restrict or terminate access to the Services if these Terms are violated.
7. Intellectual Property
Peekaboo Planet and its associated software, AR experiences, graphics, characters, animations, audio, educational materials, text, designs, logos, trademarks, and other content are owned by or licensed to Peekaboo Planet LLC and are protected by applicable intellectual property laws.
Use of the Services does not transfer ownership of any Peekaboo Planet intellectual property to you.
You receive a limited, personal, non-exclusive, non-transferable, and revocable right to use the Services for their intended purposes.
8. Purchases and Subscriptions
Some Peekaboo Planet features or content may be offered for free, while additional content or functionality may require payment in the future.
Purchases made through Apple's App Store or another third-party platform may also be subject to that platform's payment, cancellation, and refund policies.
Prices, subscription options, and available features may change from time to time as permitted by applicable law.
9. Third-Party Services
Peekaboo Planet may contain links to or integrate with third-party websites, platforms, or services.
We are not responsible for the content, availability, privacy practices, security, or terms of third-party services. Your use of those services may be governed by separate terms and policies.
10. Availability and Changes to the Service
Because Peekaboo Planet is an evolving product, we may add, modify, test, discontinue, or improve features and content over time.
We do not guarantee that every feature or piece of content will always remain available or that the Services will operate without interruptions or errors.
11. Disclaimer of Warranties
To the extent permitted by law, the Services are provided on an “as is” and “as available” basis.
Peekaboo Planet LLC makes no warranties that the Services will always be uninterrupted, error-free, secure, or meet every user's particular expectations or educational objectives.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Peekaboo Planet LLC and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to the use of, or inability to use, the Services.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
13. Changes to These Terms
We may update these Terms periodically as Peekaboo Planet and its Services evolve.
When we make changes, we will update the “Last Updated” date above. Where required by law, we will provide additional notice or obtain consent.
Continued use of the Services following an applicable update constitutes acceptance of the revised Terms to the extent permitted by law.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
